Partner Program Terms

Terms for Truffle's affiliate and agency partner program, including commissions, attribution, payouts, and prohibited conduct.

These Partner Program Terms (the “Partner Terms”) govern participation in the Truffle partner program (the “Program”) operated by Truffle Spritz, Inc. (“Truffle”, “we”, “us”). By applying to or participating in the Program you (the “Partner”) agree to these Partner Terms. The Truffle Terms of Service and Privacy Policy also apply to your use of any Truffle service. If these Partner Terms conflict with the Terms of Service on a Program matter, these Partner Terms control.

1. The Program

The Program has two tracks. Both earn the same commission on the same terms.

a) Affiliate track. For consultants, creators, advisors, franchise operators, and other individuals or businesses who refer customers to Truffle.

b) Agency track. For staffing agencies, recruiting agencies, and fractional recruiters who refer their clients to Truffle, whether or not the Partner also uses Truffle on its own account.

2. Eligibility

To participate you must:

a) be at least 18 years old and able to enter a binding contract;

b) not be a current Truffle employee or contractor;

c) not sell, develop, or market a product that competes with Truffle (including candidate screening, one-way video interviewing, or pre-hire assessment software);

d) provide accurate application and payout information and keep it current.

Truffle may accept or decline any application at its discretion and may remove a Partner from the Program at any time under Section 9.

On acceptance, Truffle issues the Partner a unique referral link. The Partner may share the link on its own website, in its own newsletters, in direct conversations with prospects, and on its own social accounts, subject to Section 7.

Truffle does not issue affiliate coupon or discount codes. Any page or post claiming a Truffle affiliate discount code is unauthorized.

4. Attribution

a) Attribution window. A prospect who clicks a Partner’s referral link and starts a Truffle account within 90 days of that click is a “Referred Customer” of that Partner. Attribution is last touch: if the prospect clicked more than one Partner’s link, the most recent click before signup wins.

b) Manual recording. While Truffle’s affiliate tracking tool is being rolled out, or where a cookie was not set, Truffle may record attribution manually from the Partner’s written referral notice and Truffle’s own records. Manual attribution requires the Partner to notify Truffle of the referral by email before the prospect starts an account.

c) Not eligible. The following are never Referred Customers: any person or company that had a Truffle account (including a trial) before the referral click; the Partner itself or any entity it owns or controls; anyone the Partner induced to sign up with cash, credits, rebates, or other incentives; and anyone acquired through conduct prohibited by Section 7.

d) Truffle’s records govern. Truffle’s tracking and billing records are the sole basis for attribution and commission calculations. Truffle will explain a disputed decision on request but its determination is final.

5. Commissions

a) Rate. Truffle pays the Partner 25% of Net Revenue received from each Referred Customer during that customer’s first 12 months of paid subscription, measured from the customer’s first paid invoice.

b) Net Revenue means the amounts Truffle actually collects from the Referred Customer for Truffle subscriptions, overage charges, and credit purchases, less refunds, chargebacks, credits, discounts, and any taxes, duties, or payment-processing reversals. Free trials, free credits, and unpaid invoices generate no commission.

c) End of the commission period. No commission is earned on payments received after the 12-month period, on renewals after that period, or on any account after the Partner leaves the Program.

d) Clawback. If a payment that earned a commission is refunded, charged back, or reversed, Truffle deducts the related commission from the Partner’s balance, or invoices the Partner if the commission was already paid.

6. Payment

a) Cadence and hold. Commissions become payable 30 days after the underlying customer payment (the “hold period”), which covers refunds and chargebacks. Truffle pays approved balances monthly.

b) Minimum payout. Truffle pays when a Partner’s approved balance reaches $50 USD. Smaller balances carry forward to the next month and do not expire while the Partner remains in the Program.

c) Method. Payment is made by PayPal, bank transfer, or another method Truffle offers through its affiliate tool. Payment-provider fees may be deducted from the payout.

d) Taxes. The Partner is responsible for all taxes on commissions. Truffle may require a completed W-9, W-8BEN, or equivalent before paying, and may withhold where the law requires.

e) Currency. All amounts are in US dollars.

7. Prohibited conduct

The Partner must not, and must not permit or encourage anyone else to:

a) Bid on Truffle’s brand. Buy or bid on search, display, or social advertising that targets “Truffle”, “hiretruffle”, “Truffle Spritz”, misspellings of them, or those terms combined with any modifier (for example “Truffle pricing” or “Truffle login”). Do not bid on Truffle customers’ or competitors’ brand names to redirect traffic to Truffle either;

b) Run coupon, deal, or incentive traffic. List Truffle on coupon or deal sites, publish or claim discount codes, or offer cashback, rebates, credits, or other incentives to sign up;

c) Send unsolicited messages. Send bulk email, SMS, or direct messages promoting Truffle to people who have not asked to hear from the Partner, or otherwise violate anti-spam law (including CAN-SPAM and CASL);

d) Misrepresent Truffle. Make claims about Truffle’s features, pricing, results, customers, or compliance that do not appear on hiretruffle.com, or imply the Partner is Truffle or speaks for Truffle;

e) Hide the relationship. Publish reviews, roundups, sponsored posts, or other content containing a referral link without a clear and conspicuous disclosure that the Partner may earn a commission;

f) Cookie-stuff or manipulate attribution. Set the referral cookie without a genuine click, use iframes, redirects, pop-unders, or scripts to force attribution, or register accounts on behalf of prospects;

g) Refer prohibited accounts. Refer yourself, your own entities, existing Truffle customers, or anyone described in Section 4(c);

h) Register look-alike domains or accounts. Register domains, social handles, or app-store listings containing “Truffle” or “hiretruffle”;

i) Violate the law or the Acceptable Use Policy. Including the Truffle Acceptable Use Policy and all applicable advertising, privacy, and consumer-protection law.

Disclosure. Wherever the Partner shares a referral link, the Partner must disclose clearly and conspicuously that it may earn a commission, in line with the US FTC Endorsement Guides and any equivalent local rules.

Any breach of this Section forfeits all unpaid commissions and may result in immediate removal from the Program.

8. Use of Truffle’s name and marks

Truffle grants the Partner a limited, revocable, non-exclusive license to use Truffle’s name, logo, and approved marketing assets solely to promote Truffle under these Partner Terms and in the form Truffle provides. The Partner must not alter the marks, combine them with its own, or use them in any way that suggests endorsement of the Partner’s own products. All goodwill from that use belongs to Truffle. The license ends when the Partner leaves the Program.

9. Term and termination

These Partner Terms start when Truffle accepts the Partner’s application and continue until either party ends them.

a) The Partner may leave the Program at any time by emailing hello@hiretruffle.com.

b) Truffle may remove a Partner at any time, with or without cause, on written notice (email is enough).

c) On termination for any reason other than the Partner’s breach, Truffle pays approved commissions earned before the termination date, after the hold period and once the balance meets the minimum payout. On termination for breach, unpaid commissions are forfeited.

d) No commission accrues on any customer payment received after the termination date.

10. Relationship

The Partner is an independent contractor. Nothing in these Partner Terms creates an employment, agency, joint-venture, or franchise relationship, and the Partner has no authority to bind Truffle, make promises to prospects on Truffle’s behalf, or negotiate pricing.

11. Confidentiality and data

Program information Truffle shares with the Partner that is not public (commission reports, conversion data, roadmap details) is confidential. The Partner must not share it without Truffle’s written consent. The Partner must not send Truffle personal data about prospects beyond a business contact name, company, and email, and must have a lawful basis for any data it does share.

12. Disclaimer and limitation of liability

The Program is provided “as is”. Truffle does not guarantee any level of traffic, conversions, or earnings. To the fullest extent permitted by law, Truffle’s total liability to the Partner arising out of the Program is limited to the commissions payable to the Partner in the six months before the claim arose, and Truffle is not liable for any indirect, incidental, or consequential damages.

13. Changes to the Program

Truffle may change these Partner Terms, the commission rate, the attribution window, or the minimum payout on 30 days’ notice by email or by posting the updated terms at hiretruffle.com/legal/partner-program-terms. Changes apply to customer payments received after the effective date of the change, not retroactively. Continued participation after the effective date is acceptance of the change.

14. General

These Partner Terms are governed by the same law and venue as the Truffle Terms of Service. They are the entire agreement between the Partner and Truffle about the Program and replace any earlier discussions. If any provision is unenforceable, the rest remain in effect. The Partner may not assign these Partner Terms without Truffle’s consent.
